The Supreme Court of Ghana has ruled in favor of conveners of #FixTheCountry campaign.
The apex court presided over by Justice Yaw Appau today Tuesday, June 8, 2021 quashed the order by Accra High Court restraining campaigners of #FixTheCountry movement from embarking on demonstration.
Recall that the police filled an ex-parte motion at Accra High Court against the planned demonstration and got a ruling in its favor.
According to the High Court, the protestors are restricted indefinitely until the ban on public gathering is lifted.
The conveners subsequently took the matter to Supreme Court.
In a unanimous decision today, a five-member panel to the apex court held that the High Court exceeded its jurisdiction by making the restraining order to last indefinite.
According to the court, by the operation of law, the order which was secured ex parte by the police on May 6, is supposed to last for 10days , and therefore the High Court acted in error by making it indefinite.
